Introduction
Welcome to Hire Loyal Pvt Ltd. These Terms of Service (“Terms”) govern your access to and use of our website and services, where we connect buyers and sellers for the purchase and sale of digitally deliverable services. By accessing or using our platform, you agree to be bound by these Terms and all applicable laws and regulations.
1. Services Offered
Hire Loyal Pvt Ltd is a marketplace that allows registered users to offer and buy professional services that are digitally delivered. No physical goods are to be exchanged via our platform.
2. User Registration and Account Management
- Account Creation: Users must provide accurate and complete registration information. As part of our registration process, users are required to undergo identity verification.
- Account Responsibilities: Users are responsible for maintaining the confidentiality of their account information, including passwords, and for all activities that occur under their account.
- Age Restriction: Users must be at least 18 years of age to use our services. Users under 18 are not permitted to use our platform.
3. Transactions and Payments
- Payment Processing: Transactions on our platform are processed using third-party payment management systems.
- Supported Payment Methods: We accept various payment methods including credit cards and selected local bank payments in certain countries.
- Fees: We charge 10 to 20% service fees on our platform.
4. Content Ownership and Rights
- Ownership and Licensing: Unless explicitly stated otherwise by the seller, when a buyer pays for a service, the buyer is granted all intellectual property rights, including but not limited to copyright in the work delivered. This transfer and assignment of intellectual property to the buyer are contingent upon full payment for the service. The seller waives any and all moral rights therein.
- Rights Specified: For services where a specific license is required, sellers must include these terms within the service description. Buyers receive rights as specified by the seller which may include limitations or exclusions as per the agreed terms.
- Commercial Use: Some services may require an additional purchase of a commercial use license. Sellers must clearly specify this requirement and the terms of the commercial license in their service description.
5. Prohibited Services
Users are prohibited from offering or requesting services that:
- Involve any form of illegal activity.
- Include false, misleading, deceptive, or fraudulent content; bait and switch; keyword spam.
- Promote academic dishonesty.
- Contain adult-oriented or pornographic materials.
- Promote or support hate speech, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Violate any intellectual property rights of others.
- Are intended to harass, abuse, or harm another person, or are invasive of another’s privacy.
- Involve the sale of regulated goods and services.
6. User Conduct
Users must adhere to standards of conduct that ensure a respectful and lawful use of Hire Loyal Pvt Ltd. Prohibited activities include, but are not limited to, fraud, copyright infringement, and activities that violate Pakistani law or the rights of others.
7. Dispute Resolution
- Dispute Process: In the event of a dispute between users, parties are encouraged to resolve the issue amicably. If resolution cannot be reached, users can open a dispute to be reviewed by the Hire Loyal team.
- Resolution Mechanisms: We offer a mediation process handled by our internal team to facilitate resolutions.
8. Confidentiality
Sellers should recognize that there might be a need for Buyers to disclose certain confidential information to be used by Sellers for the purpose of delivering the ordered work, and to protect such confidential information from unauthorized use and disclosure. Therefore, Sellers agree to treat any information received from Buyers as highly sensitive, top secret and classified material. Without derogating from the generality of the above, Sellers specifically agree to (i) maintain all such information in strict confidence; (ii) not disclose the information to any third parties; (iii) not use the information for any purpose except for delivering the ordered work; and (vi) not to copy or reproduce any of the information without the Buyer’s permission.
9. People Share
Any individual is responsible for any action against posting about sharing his/her/them personal experience and fraud he/she/them met.
10. Limitations of Liability
IN NO EVENT WILL HIRE LOYAL PVT LTD, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR PLATFORM, ANY WEBSITES LINKED TO IT, ANY CONTENT ON OUR PLATFORM OR SUCH OTHER WEBSITES, OR ANY SERVICES OR ITEMS OBTAINED THROUGH OUR PLATFORM OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
11. Modifications to Terms of Service
We may modify these Terms at any time. Changes will be posted on the same page as the Terms. Continued use of our services after changes have been posted will constitute your acceptance of such changes.
12. Governing Law
These Terms are governed by the laws of Pakistan without regard to its conflict of law provisions.
